I have said for years that you should be able to sue anybody for anything - BUT, if you lose in court, then you should have to pay out the exact amount that you were suing for, plus legal fees for both sides. That would IMMEDIATELY stop all the frivolous lawsuits. Sure, you can sue for $15M, but you'd better be prepared to pay out if it doesn't go your way. An additional benefit to this would be that scumbag lawyers would be more cautious about which cases they take. (I mean no offense to good lawyers - I have a few lawyer friends who are fantastic people and are trying to make the world better.)

Actually, the estate doing the lawsuit isn't really the problem (give or take the outrageous amount). The dead guy wasn't the incompetent mechanic - he was just innocently standing in front of the car when the idiot manually popped the clutch. It's crazy that the car owner gets looped into this mess, but it appears that's the only path for the dead guy's estate to collect. You have to blame the lawmakers here, along with the idiot dealer that hired an in competent mechanic. Fortunately, it looks like the dealership will ultimately end up covering the loss. But, if I were the owner, I'd be asking the dealer to cover the loss, plus attorney's fees, future insurance impact, loss of vehicle use, emotional distress, and anything else my attorney could think of. (And I hate lawsuits.)

The owner sued the dealership to indemdify him and won. The dealer and it's insurance will have to pay.
