I bought this new from Mina Gallery for my 2013 3.0 Supercharged XF. I had one on my new 2009 4.2 V8 XF also and never had a problem with either exhaust, nice quality exhaust.
There is no damage to the exhaust but it could use a nice polish before install. I am in Southern California. $600

This was on my car for almost 3 year's and was installed at 22k miles and removed at 44k miles along with my 21" wheels and tires a couple months ago. I removed these items because I am going to sale/trade in my car before it hits 50k miles and four years old 4/20/17. I have a 2013 XF that I ordered new with sport package and every other option besides adaptive cruise if anyone is interested.

They are smog legal and do not affect the emissions, so there is no CEL worries. I do not know what the difference is on mounting the exhaust on a 2009 vs a 2013. You would need to ask Mina Gallery to get the correct answer. Frank
