Someone backs into you in a Wallgreen's parking lot, and this happens...

So naturally, being hard times and all, the offending party's insurance company doesn't want to pay because (hope you're ready for this) I didn't call the police and have them come and fill out a police report! Of course, the fact that I have the driver's handwritten name, address and phone # on the back of a Wallgreen's prescription pad sheet, and copies of the registration and insurance policy cover sheet provided to me at the scene means nothing to the insc co. Plus the offending driver is not answering or returning the insc co's phone calls, and refused two certified letters.

So I faxed them copies of everything and told them I was going to notify the NC Insurance Comm if they didn't snap out of it. When I got back from FLA last week there was a message from the insc co, so we'll see about that Mon.

They wanted me take a police officer away from whatever other more important things he might be handling for a parking lot dent. Are these the kind of priorities we should be developing as a society as the national debt soars?

sheeat...I feel your pain skid mark

quick story - my wifes car was parked up ( stationery ) she wasn't even in the car and a woman reversed into her car in her SUV. This was spotted by a member of the shopping centre as well as an off duty police officer. My wife was contacted and took the details off the woman, as well as the 2 witnesses. Not a major bump and she asked us to leave the insurance company out of it, get estimates and she'd pay direct.
What a nightmare this turned out to be!!!!!

Eventually got it resolved, but from now on, the police will be called and the insurance co notified at all times

I really do hope you get your situation resolved ASAP.
If necessary, check with the parking lot owners for cctv footage that might help....you never know you might just need it

Go by the local police department and have them file a police report. State that you originally did not call the police since the other driver gave you his/her information. You should still be able to do it.

I went to the police department and they just gave me a blank report form. I filled it out and sent it to the insurance company which promptly paid up.

Yes go and have a report filled out. My wife was hit in the parking lot and she called the police but they did not fill out a report but exchanged the information for us. His comment was it is on private property. I think that is a lame excuse for your insurance co. not taking care of you.

The same door. The girl was backing out of the parking spot.

That's good news! I would think if someone is willing to sign a police report the insc co should believe them!

In a situation like this, go to your insurance company with all of your 'evidence' and they should not only take care of your damage (ask first if it will affect your premiums) and then they will pursue the other driver's insurance company. I've done it before. Was the other insurance company Geico by chance? My sister just had an accident, she got photos of the car's front to back with the damage, photos of the lady's insurance card and license plate and driver's license...and geico didn't want to pay the claim, the driver denied the accident...until my sister emailed all of the photos to geico...absolultely incredible not accepting responsibility.

You did good. All will turn out allright. Just try not to look at the dent.

In any incident you should always go though your own insurance and let them handle it. They are working for you. They will go after the other insurance company and driver to recoup moneys owed. I have been in a couple of similar incidences and just called my agent and they took care of everything Even if i didn't call police (but calling does make it much easier in the long run)

Uh-oh. I wish I hadn't seen this post. I got rear-ended yesterday afternoon by a Chevy Trailblazer. We exchanged information but didn't call the police and I didn't take pictures either.

The damage is very slight, just scrape marks in the paint on the top of the bumper where it got pushed in and some scrape marks with a tiny dent on the vertical part of the bumper where her license plate hit me (although it bent her license plate so that the top curled over). My sensors seem to be fine so it should just be a little paint work.

She was crying up a storm saying that their insurance almost got cancelled before and now it will be for sure....... I'll be calling the insurance companies (hers and mine) when they open at 9:00.........

My wife and myself got hit 3 times last year. We haven't had a accident in forty years between us. Once in the Lexus, rear ended, about $4000.00. Twice in the Jag Kissed the front bumper once on the right and once on the left. The first time in the jag was on private property. If it's under $1500.00 in the state of Illinois you don't have to file a police report, but her insurance company required it so I filed it four days later. They paid in full off my estimate. The second incident a 17 year old ran a red light and got T-boned by a full size Caddy. spinning her car off the expressway and just kissing my front bumper when it came to rest on a side road where I was waiting at a stop light. Totaled both cars. Damage was $1200.00 to my bumper. My insurance agent said wait and see what her company would do. Her insurance company wanted to pay $470.00 and drug it out for two months. Then I turned it into mine, they paid the full amount less deductible. and then paid me my deductible about two months later. The Lexus was settled with out incident including medical for the Chiro. The big difference was the insurance companies two well known and the third who didn't want to pay was a company for people who have a problem getting insurance. You can file a police report after the accident, but if you have problems your insurance should help you get a fair settlement, that's what they are paid for. Also our rates never went up because of this.

After a false start with her insurance (she gave me an invalid phone number), they will now have to assess liability. An Adjuster will call me............ Why do I have a bad feeling?

Bad feeling - justified.

Just heard from the adjuster who says the woman who hit me is claiming she was pushed into me and the "other" driver ran, therefore it is not her fault either. What?!

Since I had the top down, I'm pretty sure I would have heard the first thunk before I heard and felt the big thunk that hit me. Plus, I looked at the back and front of her SUV at the time and there was no damage to the back. And then she pulled over behind me into the shopping center; there was no discussion of someone hitting her or the description of a car, etc. What BS!

I am just amazed that people won't take responsibility for their actions!

I guess I'd better get on over to Momentum and get an estimate......

Did you ask your insurance agent first Ann? They may know the proper response for such an 'avoidance' tactic.

No Matt, the reason being: we both have State Farm, so I figure the response will be the same.

However, the person who hit me and I each have our own SF adjuster, so I guess the adjusters will have to duke it out.

All I know is that I'm not payin' a dime. I had someone very familiar with Jags look at it over the weekend (within minutes of this happening) and he is of the opinion the top-of-the-bumper scratches can probably be buffed out. (So it's the little dings and the bigger scratch on the back that need to be taken care of).

Good Luck with State Farm, My daughter was sitting a a light in a turn lane when car ran a red light and hit the rear end of her Chevy Cavlier. The Guy driving was a wanted felon, no license who borrowed the Ford Escort from his girl friends father who also had State Farm Insurance. He got hauled off, and ticketed. They put her a 30% to blame for being on the road. So she had to pay her deductible. Also those dings and scratches can run into complete painting for your bumper.

30% blame for being on the road? Why do I find that just plain stupid?!What's the point of having a car (and the insurance to cover it) if not to be on the road?

In my case, it appears I dodged a bullet. The adjuster called me back late yesterday afternoon and the woman accepted responsibility. I guess the story fell apart when the adjuster grilled her about her damage and said she'd have to look at it.

I went to Momentum and they were able to give me two quotes (their body shop and another one that they use), and the estimates came in at under $600.00. It's a little higher than I expected, but everything is always a little higher when a Jag is involved.

I was given the claim number and the phone number for the customer service team and I'm assuming I send them the estimates and they send me a check, I'll call this morning and find out. So all's well that ends well.

Here's something interesting.. I got a lawyer because of my accident in May. The other party has State Farm and would not give my lawyer any information about the woman's coverage UNTIL the Grand Jury decided to bring her to justice.

State Farm sent my lawyer all of the information he had requested and said they would pay for everything and it just so happens the letter was dated the same date as our meeting with the Grand Jury.

Also... I have Allstate. Before I hired a lawyer, Allstate paid the full amount of what I owed on the Jaguar, plus loss wages (well most of it, they only pay $3000 per month) and some of the bills like Life Flight. BUT as soon as I got a lawyer they stopped talking to me.

There are so many loop holes and behind the back door deals that take place in a bad injury accident it is a very good idea to get yourself a lawyer.
