Yes, the back seats fold forward, effectively doubling cargo space, which is considerable otherwise.

I've started a paper trail, not being exactly trusting of bureaucrats, car salesmen or insurance adjusters, who, as you say, are looking out for their own interests first (no offense intended, Carl).

We thought we would give them reasonable time to come to a resolution; after 30 days I'll start rattling cages, after 45 days I'll get more persistent, and after 60 days I expect positive answers or good reasons why I don't have any. After that I'll see which way the wind blows and take it from there.

Of course, never having this sort of dealings before, those times may lengthen drastically.

You are entitled to a much faster response to the claim made against the OP via her insuror. Write them and state your claim. Provide evidence to support. Insist on a response, within a reasonable time period.


But, in time of crisis, I and my bretheren can and have been of con siderable help. Loss of homes in natural disasters. My last experience in helping a whole lot was in the Oakland Hills fires. Cash advances. Temporary housing. Rented furniture. Most of those lost homes cme back better than ever....

They came and got Wart a couple days ago and took him to an inspection station.

I got a call from the Inspector yesterday, they have declared him a total loss. Big Surprise! (Not!) Next begins negotiations for his actual value on the open market and what percentage of that the Other Person's Insurance Company is willing to fork over. I have documentation of that value as a starting point. That sum will be in addition to the cost of a weeks' car rental of course.

This could be entertaining. (It will Definitely be a learning experience.)

Even though the sun is out for the next 7 days it's still too cold and windy to do anything outside. However, the replacement vehicle is proving quite adequate, I'm under no pressure, and I'm easily bored in February so I can take my time.

On the other hand, time is money for most Mercan companies so they'll doubtless want to settle as soon as possible.

If nothing else, it will be Interesting.

Since I was the driver in this incident, they only want to deal with me, even though Wart was joint owned. That makes perfect sense. After all, he wasn't there at the time so what could he contribute, but husband thinks they'll simply bulldoze me as a mere woman.

Naa, I don't think so.......

Actually, on recollection, I think I found men easier to deal with than women!!!


% of ACV??? Why, do they argue that you were negligent is some way and that negligence contributed to the collision? Known in law as "contributory negligence". A concept created by CA's supreme court, back in the 60's!! Insurors thought the end of the world had arrived!


Odd, they would incur tow fees to move Wart. Brought him back?
usually, the inspector/appraiser sees the car at a chosen repair shop or at your place.


Doing a similar thing for daughter. Just crossed swords with a gal from the OP insurer. Their insured in a big Ram truck backed into my daughter's Passat while she was at the rear with hatch open loading it!!! Passat fine, her knees not so much!! Ouch.

I hope you get a good outcome Elinor.

In this country (or in this state at least) a vehicle can only be owned/registered by a single entity i.e. one person, or a company etc. However, joint names on vehicle insurance is permitted, so we did that for each of our cars about a year ago. Makes it easier for either of us to deal with an issue and eliminates the frustration of hearing: "sorry, we can only speak to the policy holder, and the fact that he or she is overseas at the moment doesn't change anything"!

I gave my statement to both insurance agents, mine and theirs. I only told them what I knew, not anything I extrapolated must have happened. If I didn't know, I said I didn't know. The Other agent seems like a nice enough person to deal with at this point.

Since the Other Person was found to be at fault I will wait for the settlement offer before I plan a response. There could be no other conclusion actually, because the collision happened right at the intersection, in my lane, my tracks in the mud are still visible less than 50 feet beyond.

Wart did a good job keeping me out of that flooded ditch. I could easily have landed on the side in 3 feet of water or even upside down, but only the right rear corner was in the water. It could have been a LOT worse!

I thought maybe that by my description of the damage and pictures I sent, they had decided before even laying eyes on Wart that he was gonna be a total. The transport driver agreed saying insurance companies don't even want to deal with a rear quarter panel, they total almost all of them. The fact that even the roof was deformed above the sliding door only clenched it for me.

I knew once he left here he'd never be back, and I'm OK with that actually! Wart served us well right to the end, but his time was up.

Take the initiative and e mail them. Tell him what you want
and why. Supporting documents as well. In your case a market
comparative search.

Fixed my faulty float in the one of the toilets. Easy fix failed. Took tons of tools and a new flush mechanism. Amazingly economical at just short of eleven bucks. Now, good for more years than I am!!
The flush of victory, even if a simple task for an "expert". I sure am not a plumber!!!

Carl was right, I had to rattle the Other insurance company's cage regularly, in a nice way of course, to be sure progress was being made and I wasn't forgotten. Thank you for that tip, Carl!

I made it a practice to call the adjuster's number every Monday morning just as she should be at her desk and keep trying until I spoke to a human. This approach proved successful.

As I was not injured in any way, the only question was their valuation of Wart. They made a Very generous offer, which, after about .05 seconds' consideration we accepted. >Clink!<

All documents have been exchanged and I'm told the check will be in the mail tomorrow. It will cover about half the cost of the Adequate Vehicle and Wart is Gone! A separate check is already in the mail to cover the week's rental car.

I shudder to think what will happen to the Other Person's rates because of this.

Good job. All is well that ends well. Happy that no one got hurt.
Tin is tin and fixed or replaced, flesh not so much!!


Makes sense to me that negligent drivers should pay more than
careful ones!!!


As the weather was fair, Coco and I went to market in the Jaguar.
He prefers riding there. As he is along in years, as am I, it is easier
to jump in it than the Jeep. I can give him a "boost", but, he has eaten quite well!!!!


Weed whacking in the front yard in progress. Got put my propane torch and freed the racheting action in my old time brace. it's chuck accepts only old type bits with a squared shank. I have a selection!!!
Some counsel cutting the square off so that a Jacobs type chuck can accept them. Glad I did not. I have lots of "modern" bits.


Continued work on the old "spoke shave". Nice piece. Removable blade.


The old "egg beater" style drill resists heat and solvents. Stuck....

The sky is clear, the sun is bright, the Almonds are blooming, the first harbingers of Spring, and my work has already started.

A bit back, when I was "'working" for money, I visited
a family that moved to a small almond orchard from the
"bay area" for their kids sake. Great move. He, a talented
welder served super markets by weld repairs of their
stuff. Carts, ladders, lifts etc.


Envy, oh yeah!!!
