Post 03' X-type 3.0L Gearbox fault comes on after starting does NOT go in limp mode

2003 X-type 3.0L Automatic 5 speed
When the car is started the gearbox fault shows up. With obdii scanner no faults come up. Erase all codes with obdii (if you don't clear the codes the car will engage limp mode.) Shift and drive - transmission shifts normally. All gears engage. Car runs fine and the gearbox fault doesn't return and limp mode does not engage. Turn car off and restart, need to clear codes again. ABS light is on - don't know if related. Map in the navigation is missing - no CD/DVD to fix that. All other menu items are fine. I have done the following:
  1. had no cruise available fault. That fault is gone. Need to check that the dashboard cruise light, lights up
  2. adjusted the J-gate
  3. changed transmission fluid
  4. transmission range sensor changed out
  5. checked wiring connections
  6. air intake pcv valve hose was lose - tighten it
  7. TCM has been taken off, checked for corrosion - none found, was not wet and put back in
  8. bought new battery - need to take back wrong size
I'll be checking the rest of the fluids - transfer case, final drive (rear end) etc. Everything seems to be okay, lights, electrical, radio. Have the owners workshop manual. I don't know where else to look or what to do next. I'm looking for advise on what to do next. Thanks
