The dreaded 'restricted performance' !!

I have a 2008 XJ 2.7TdVi. (just done 54k - Had a new engine under warranty so I bought it with 20k on the clock) Never let me down in the last 2.5 years but unfortunately I got dashboard disco yesterday and today with 'restricted performance'. This does not go away as other people's have and my engine is limiting to 2700rpm and very steady building up revs.
I've seen people mention battery voltage - I've checked static and loaded and this is grand. I've also tried it in each gear - no difference. Also this is the same in park.
A couple of months ago I was getting fumes into the cabin. Also when I stopped at lights with the lights on I could see fumes seeping out of the front left lights and sometimes the back left of the bonnet near the windscreen wiper. This was only intermittent.
Had a good look around the car (or as good as one can) and I noticed engine oil down the rear face of the engine. Seal behind the rear timing belt for the fuel pump. Thought this was getting onto the hot exhaust and causing the smell. I changed the seal - not a job I'd recommend. But I still got the smoke every now and again.
I mention this as I'm hoping the de-rate is due to the EGR system (hopefully just a crack) rather than a Turbo which a lot of people suggest. I assume if there is an inbalance in the exhaust back pressure (or some sensors associated with the EGR) the engine de-rates.
Some people mention the turbo wastegate which I would think is an easier fit than a turbo - although I guess the turbo may have to come off to sort this. Note that neither bank smoke when revved statically or whilst driving under restricted performance.
Any help would be appreciated.
