Default The Jag died a horrible death!

Sad to report that the 05 XJ8L I bought yesterday was hit by a Lexus turning left in front of me! I was leaving the dealership and had gone about a mile towards the freeway on ramp. As I drove thru a green light this Lexus turns left and I hit his right front. Both cars are totaled. The good news is I have full coverage and "GAP" insurance, the bad news is I lost my cash down payment. I'm not sure I'll be back on the forum any time soon. Anyone in Northern California need parts? It has navi. 6 CD and light grey interior. Engine and trans have 99,000 miles. Car in excellent condition from the doors back. Nothing will be available for probably a month until all the dust settles!

Surely, even in the People's Republic of California, your full loss is covered by the other guy if it is his fault?

Yes it is. I had an accident a few years ago. The police accident report blamed the other party 100%, so I was able to recover my full loss without any difficulties.

Having wasted my youth as claims adjuster (before the draft board caught my young butt), a lot depends on how fast he was pushing his brand new cat before the other guy jumped in front of him: best case, the other guys fault; worst case, contributory negligence, especially if both cited for reckless driving.

I get your point! the light had just turned green I accelerated to maybe 25. No skid marks. Air bag deployed. He had no left signal on and he assumed I was turning right to access the eastbound on ramp as well. Bad assumption on his part! I'm saying totaled because of the age of the car and air bag deployment. No official word yet.

Oh yeah, it's totaled. But don't just take the insurance guys's word for your claim. In most states, you are entitled to full loss coverage which is pretty easy to prove since the car was just bought. Full cost plus expenses like a rental until they pay and the Uber you took home.

From your description, it sounds like it is all on him. Was there a police report? Going to be clearly his fault if he was within 500 feet of the green light (California Boulevard law).

No report! Sacramento police said no injuries, both had full coverage, both of us had valid drivers licenses. They said the insurance companies will decide once 2 inspectors see the cars.

Both cars totaled and no police report: Sacramento or CHP guys getting lazy.

Update..... yesterday my insurance adjuster did the estimate on repair. Car's worth 10 to 11,000 dollars, Cost to repair 17000 dollars!! Car is TOTALED! Now we go to the second step, what am I getting paid regarding car only? They say market value plus what I paid for State sales tax. My concern is whether one check is written to the lien holder and he reimburses me the $3500 down payment OR 2 checks are written one to satisfy the $7000 lien and one to me for $3500 plus the sales tax on $10,000?

Ask for two checks and start searching for another. If you are going for another x308, ask how much to buy the cadaver -- parts car!

Update: the other party's insurance took responsibility! Value in this market adjusted for mileage is $12800. I paid $9800 plus 9% county sales tax. So it looks good!

Well..... yesterday I went to Roseville about 60 miles from me north and bought an 05 Super V/8! Metallic Red with tan leather 99,000 miles. Same money as the Grey one. One owner and serviced by the Sacramento Jaguar dealer for 9 years. So I'm in the group finally!

Update! Two checks are being written. One to lien holder one to me. It appears I'll get my down payment back and sales tax and license fee. Should realized close to $5000 total. Farmers is still on the hook for medical. Boy I'm glad I ended up with this SUPER V/8!

Glad this turned out well.

Now, it is time to get over to the right forum. Your car is in the X350 forum (X308s are for steel body XJ8s from 98 - 03).

You may need to file an accident report with DMV based on loss amount and medical expenses you are now reporting (hopefully just tests to assure no harm).
