40ma is just about ok.
Some cars will even struggle to turn over at 12.02v. You really need to have at least 12.5v.
Disconnect your battery and charge it to a minimum stable voltage of 12.75v. Don't rely on the measurement immediately after disconnecting the charger. You need to leave it for at least 5 mins and then measure it. Now leave it disconnected and measure it after 24 hours. Then do the same test with it connected and see the difference of a 24hr drain with it connected vs a 24hr drain with it disconnected.

just giving an update; car is doing fine, no more gearbox warning lights... I'm happy , and it starts to feel reliable now, its a treat to drive it, although still a bit frustrating I couldn't really say what the exact solution was... anyway..
