Default Brake lights mystery

I was following my wife in her 2002 VDP last night and noticed her brake lights were staying on--but NOT the upper third light. When she applied the brakes, the third one come on. When she released the brakes, the third went out, and the two lower ones momentarily winked out, but then immediately came back on and stayed on. This repeated at every stop. At home in the garage I tried to duplicate the issue, but they seemed to work correctly, with headlights on or off. I'd assume a stuck pedal switch IF the upper light was also staying on. (I also made sure it was not the rear fog lights that were on). I'm out of ideas--has any group member seen this before? Thanks for any advice!

Check to make sure the rear fog lights aren't on. These cars have two of them and when they're on it looks like you're righting the brakes with no CHMSL illuminated.

I’m pretty sure they don’t stay stay on “between starts” and, like traction control off and the seat heaters etc., they reset to a default off when the ignition is turned off.
