If you initiated a buyback because the car got quieter... It wouldn't surprise me if they rejected it. It's subjective and everyone can claim "I don't hear the difference"... and to be fair it comes across as drastic if everything else is OK with the car... This might take more "finessing" than asking them to buy it back, though I totally understand your frustration. I thought there's already an update to the update that addressed this problem for everyone. Is your car different somehow? Or dealer is just being dumb perhaps?... another one you can go to maybe?

It's a little more complicated than that - my car got quieter with the k309 update, but that also exacerbated an underlying issue....

The active exhaust effectively use two components to create our unique exhaust note; it opens the valves in the exhaust pipping AND it sends a signal via the ECM to inject fuel and to fire the spark plugs when the exhaust valve in the cylinder heads are open. It does this on acceleration and deceleration. It's kind of like running the ignition timing very advanced and adding a dose of extra fuel at opportune times to create cool noises.

The underlying issue with these cars is that after a designated amount of heat build up in the exhaust system, the system is shutting off the signal that initiates the extra fuel and firing the spark plugs when the exhaust valve is open in the cylinder heads.

I proposed a buy back because they materially changed the function of my car without my consent and under false pretenses. This was advertised as an update to address o2 sensor malfunction and in actuality it was an emission compliance update.

The existing fixes do not work for my car because it is outside the vin range the existing fixes were designed for. I assume they made some changes along the way that made it not possible to adapt previous fixes. I hammered on my dealer quite ruthlessly and the Jag corporate for that matter - to the point they basically won't talk to me anymore. That being said, I don't think the dealer is the issue here. My dealer has several other cars with disgruntled owners and seems to be doing everything in their power to get Jag to fix it. The issue I think is very clearly with the cars software, so nothing the dealer can do.

So that's that - I've been a loyal customer, I own a full size SC range rover too and have had several others over the years. I'm obviously furious and trying to talk myself out of trolling every Jag dealer and auto show I can find. What a waste of time, money, and a potentiality awesome car.

You expected them to buy it back because the exhaust got quieter? Lol. Put on the VAP exhaust. Problem solved.

I can relate to your frustration. I drove mine for months after the original K309 caused this issue - bothered me each and every time I drove it. If the patch hadn't fixed it I would have ended up selling the car, that's how much it bothered me.If the car hadn't made pops and cracks from the start I would have been OK, however as it did, and I liked the way it sounded - I couldn't have accepted a change in behavior. I guess I am lucky that my VIN was in the range for the K309 v2 patch.

I can see where an owner has a right to be frustrated when the answer to getting a car BACK to the condition it was purchased in is 'spend more money with a vendor.'

That being said, if the true issue is emissions related, then it is ALSO something that likely came about because some snowflake in California was offended. Nowadays, the emissions world revolves around keeping that State happy...not like the days where you had Cali cars and then 49-State cars.

Even if one moved the matter to litigation, it is going to be an extremely uphill and daunting task to get a jury to believe that one plunked down $60-100K on a car SOLELY because of an exhaust note...does not matter HOW cool that exhaust note might be.

Absolutely, they materially changed what they sold you, and you make a solid point for sure but unfortunately it might take a lawyer to make the case to get them to fix it or take it back. I was under the impression that there was a fix for the fix and everyone's car got sorted with the second fix. Is it possible the second fix is not available to CA dealers and you'd have to go to a neighboring state?

You can actually put back his pops & crackles with a tune, right Stuart? Have you guys messed around with that part of the code at all? I could see myself or someone else perhaps asking for configurable overrun sound some day...

This ^^^ I've love to be able to swap between it. I'd be tempted to ask for more, but would be worried it would be too much so would like the peace of mind I could wind it back or even better, adjust it.

Should I assume this is only impacting S or R, and not base? I got the new O2, and assume the update.... and I'm no different.

To some degree yes we can. It won't necessarily be exactly the same but Chris has been working on some stuff that will make pops & crackles on the overrun, or if you rev up the engine when it is in neutral.

Adding cats will increase it further. I'm not totally certain but even on a K309 updated car it should still make a little pop & crackle with cats fitted, there's always a small quantity of fuel in there to ignite even with the update.

Got the call that it was being wrapped up late this afternoon, so I will go and pick it up early tomorrow morning. I asked about the O2 sensors and whether it was the software update...was advised that it is actually a REPLACEMENT of the sensors and not a software revision.

By way of update...got the car back this morning and am disappointed to say that I have lost some of my snap, crackle and pop. Jury is out on whether this will be a permanent thing because some of them appeared to come back, at least on decel, during the drive from the dealership to the office (about 20 miles).

Invoice reflects that this was related to Service Action K433NAS1- Heated Oxygen Sensors.

The part number for the two O2 sensors is indicated to have been T2R10752

No indication on the invoice about whether there was also any manner of software updating.

Are you serious? I have mine in the shop right now and I've been told K309 was done so I requested JTB00495NAS1 be done. I just got the car but it isn't all that talkative to me and
watched plenty of videos of the exhaust tones.

JTB attached..Here's hoping. If it doesn't sound better i'm just gonna tune it and custom exhaust.

Will update next Friday. Local Jaguar dealer has had it since Wed of last week for front end align and a service checkup. As of today service rep says they haven't been able to look at it. Such BS

I looked into this.... Jag makes their cars 50 state cars so they're all getting the same updates/fixes.

I spoke with my attorney too, unfortunately, getting a specialist to testify alone would cost me 10-15k.

Jag did offer me $1600 for myu active exhaust option....

Also, I did fit a VAP valved exhaust system this weekend - it sounds awesome. I have yet to take it out for a spirited drive yet though, so I can't comment on if it makes up for the cars update quirks. But it certainly sounds amazing in all normal situations so far.

I actually ordered a tuner from VAP too that I just received. But I think I'm getting cold feet after seeing the other user on the forum who blew his engine and had his warranty denied because of a tune. I'm not necessarily worried the tune will blow my engine, but should I have any issues, I don't want it to be blamed on the tune.

My car was recently at the dealer - no new updates were required and I already had K309 applied well over a year ago.

Same fixes/updates per vehicle. While we both have F type's, all the cars vary slightly by year and VIN range.

I would guess we have some slightly different hardware/software combinations that makes the fixes or the substance of the fixes vary somewhat, while the intended function remains much the same.
