Default Car at the dealership since 5/20/24

Hi All,
The car is under manufacturer warranty until 2026 with 10,000 miles
I filed for a Lemon Law claim l10 days ago, mail sent to Manufacturer.
I filed as well a Lemon Law Complain with DMV TX. ( 10 days ago)
I filed 3 weeks ago a complain VIA DMV Website.
Dealership provided a loaner.

Any of you went through this?
Any recommendation on my case and/or Lemon Law tips
How to mediate?

Any help would be more than Welcome

Tell us more ! So just what is wrong with the car ? My own 2017 Portfolio AWD 2 litre diesel is going OK and I've had no faults since purchase. Maybe I should sell it now while it's still OK !!

Hi Project8,

It will be very difficult for the rest of us to offer any suggestions without knowing the year, model and engine of your Jaguar, and what specific malfunctions have prompted you to invoke the Lemon Law.

At least in the US you have the Lemon law to invoke.
In the UK there is no such law, so you're much more on your own with faults, even when the car is still under warranty (which is also in the UK only 3 years instead of the US's 5 years)

Hi All,
The car is 2019 XE Project 8
Bought in 2021 with 5 years Warranty starting from 2021
The car has been at the dealership since 5/20/2024 and counting
The car went for maintenance, noises in the dash? / engine bay areas and cracks on trunk lid where the wing is attached.

Was wondering if any of you has a car for so long at the dealership? and what is next

Dealership did not provide updates during the 3.5 months.
I open a case/claim with Jaguar USA. 3 weeks ago. They called me saying that they are working on getting an update. (3 weeks?)
Jaguar Houston Central texted me to say that ...Jaguar USA has approved the work on the trunk lid and they will start working on it now.
That`s all what I got.
I initiated a Lemon Law Claim with Jaguar USA and DMV (10 days ago). As of now, no news from both.

Could it be that they are having trouble getting some part unique to the Project 8?

You might be right.
Communication was inexistent despite me asking for updates.
Funny, They of course gave me a loaner with 13 miles. Now it has 7,000 miles!
4 months is long, too long. Even if parts were out of stock. The idea "" of a Manufacturer is to have parts...
In 2023, the car stayed 1 month at the dealership. All together it is almost 6 months of "out of service". in 3 years of ownership.
If some of you have some experiences to share about dealing with the Manufacturer regarding Lemon Law Claim.

I’m assuming you’ve done some research. Auto lemon laws vary by state, presumably TX would apply to you. Then there’s the federal Magnuson-Moss Warranty Act. This site describes this fairly well, though I think they want to sell you legal services. I personally have no experience with lemon laws, though I recall a few folks on this board who went through that years ago.

Your state may vary. But, here in Kalifornistan there is a maximum time to repair law for both warranty & insurance repairs. Also, there are laws that safety devices such as airbags and seat belts must be replaced with new and not used components. My daughter works in the auto claims department for one of the large insurance companies. During the scamdemic and related supply chain issues, sometimes critical parts were not available. Multiple times they had to total vehicles when critical components such as seat belts were not available in the repair timeframe. I don’t recall the timeframe exactly, but I think it’s something like 8 weeks.

Wonder if you could sell your Project 8 with minor issues for more than you’d get by lemoning it.
